What May Be Deducted From a Personal Injury Settlement?


A settlement amount is not necessarily the same as the amount the client ultimately receives.

Depending on the case, deductions may include:

  • The attorney’s fee
  • Authorized case expenses
  • Medical bills
  • Health-insurance reimbursement claims
  • Medicare, Medicaid, or other valid liens or subrogation interests
  • Other deductions authorized by the client or required by law

Before settlement proceeds are distributed, you should receive a written breakdown showing the recovery and all proposed deductions.
